Terms of Service

These terms apply to the Excession website, the Incursion agent, and the Excession API (the "Service"). By creating an account you agree to them. Using the service means you accept the Acceptable Use Policy.
Accounts
You must be at least 18 and able to enter a contract. Keep your API keys secret; you are responsible for all use of your keys. 1 plan = 1 person: do not share a plan or an account.
Billing
- Signup credit. Every newly created account receives $5 in API usage credit once, with no card required. It is added to your USD usage balance, is not withdrawable cash or USDC, and is not granted retroactively to existing accounts.
- Plans. Plans are billed monthly in advance by card through Stripe. Each plan gives monthly plan credit in US dollars worth more than its price: Starter $30 for $20 (+50%), Pro $175 for $100 (+75%), Max $400 for $200 (+100%), Ultra $1,250 for $500 (+150%). Unused plan credit expires at renewal. 1 plan = 1 person.
- Balance. You can add funds from $0.50 to $1000 by card or supported stablecoins through Stripe, where available. Funds become your balance in US dollars, 1:1. Your balance does not expire while your account is open, also after you cancel a plan. Crypto is only for adding funds, not for plans.
- Debit order. Usage is charged per token at the prices shown on the website at the time of the request. Requests use plan credit first, then your balance. The setting "Use balance after plan credit" is on by default; when you turn it off, requests stop when plan credit is used up.
- Changes and cancellation. An upgrade charges the prorated difference at once and adds plan credit for it. A downgrade starts at renewal. You can cancel at any time; the plan stays active until the end of the paid month. Payments are non-refundable except where the law requires otherwise.
Referrals
- Your referral link gives the person you invite 10% of their first payment as balance, once. When that first payment clears, you get a balance reward: $10.00 for adding funds or Starter, $15.00 for Pro, $25.00 for Max and $50.00 for Ultra.
- A referral counts only for a new account created within 30 days of a visit to the link. You cannot refer yourself, including through the same card or Stripe customer.
- Rewards are limited to $500.00 per referrer per calendar month (UTC). A refund or dispute of the first payment reverses both rewards from the balance, down to $0.00.
- Rewards are added to your balance. We may change or stop the program at any time; rewards already earned stay on your balance.
Your content
You keep all rights to your inputs and outputs. You give us the rights we need to run the Service. We do not use your content to train models.
Outputs
Model outputs can be wrong. Check them, especially commands and code, before you run them. You are responsible for actions the agent takes when you allow them.
Suspension
We may suspend or close accounts that break these terms or the Acceptable Use Policy, or that put the Service or others at risk.
Warranty and liability
The Service is provided "as is". To the extent the law allows, Excession Labs is not liable for indirect or consequential damages, and our total liability is limited to the amount you paid us in the three months before the claim.
Changes
We may update these terms. If a change is material, we will tell you by email or in the dashboard before it takes effect.
